ISLAMABAD: Supreme Court Friday accepted appeal filed by its former chief justice Abdul Hameed Dogar against implicating him in treason trial of former President Pervez Musharraf.
A three-member bench overruled Nov. 21. 2014 order of special trial court about the nomination of Dogar as co-accused in the case.
The special trial had ordered authorities to include Dogar, former law minister Zahid Hamid and former Prime Minister Shaukat Aziz as co-accused in the case.
The bench noted the high court or the special court does not have the prerogative to order the nomination of co-accused in the treason case. Discretion in this regard rests with the federation, it said.
The order further stated that the federation only considers Pervez Musharraf responsible for the imposition of Nov 3, 2007, emergency which led to the confinement of a number of superior court judges in their houses and sacking of over 100 judges, including then Chief Justice Iftikhar Muhammad Chaudhry.
The apex court also directed to complete the trial against Pervez Musharraf at the earliest. NNI
