Justice Mansoor Ali Shah, Justice Muneeb Akhtar's letter to the Chief Justice regarding the minutes of the meeting

Islamabad: Senior Supreme Court judges Justice Mansoor Ali Shah and Justice Muneeb Akhtar wrote a letter to Chief Justice of Pakistan Justice Yahya Afridi, expressing their position in rejecting the minutes of the committee meeting.

In the letter to Chief Justice Yahya Afridi, both the judges have said that as committee members, we had decided on a full court on the 26th Amendment, but the case was not scheduled in violation of the committee decision.

The letter states that on October 31, 2024, as a committee, we decided on a full court and wrote a letter again on November 4 when the case was not scheduled.

Referring to the minutes, it has been said that the two notices written by the Chief Justice on our decision were not given to us. The Chief Justice read his note in the Judicial Commission meeting even though the Judicial Commission was not the competent forum on the matter.

Both the judges have said that the matter of bench formation mentioned in the minutes was referred to the Constitutional Bench and the Constitutional Committee, at that time the Constitutional Bench and the Constitutional Committee did not exist.
