Governor Rule : Does the Ruling Elite know something about the Constitution?

With the Interior Minister’s diatribe that he has advised the PM to impose a Governor Rule in Sindh and a counterblast by the CM Sindh to retaliate in such a rule is imposed, a commoner like me is literally worried whether or not our political coterie knows something about the Constitution? Sheikh Rasheed might have been infuriated by the show of dissidents at Sindh House but the fact is not denying that Governor Rule , after the 18th amendment is out of question. Gone are the days when Federal government was well empowered to impose it on any province on any pretext sans any check.

The 18th amendment has literally changed the legal position and now it is no more a one way traffic. Despite the power is still there but the power is not an absolute one as it used to be years back.

Article 232 empowers the President to issue emergency if the President is satisfied that a grave emergency exists in which the security of Pakistan, or any part thereof, is threatened by war or external aggression,or by internal disturbance beyond the power of a Provincial Government to control. But there are certain conditions attached to it.

If the emergency is being issued on the pretext of internal disturbance the first condition is that a resolution from the provincial assembly of the said province is must. Sheikh Rasheed has ill advised the PM.

He should have been asked whether he himself will manage the said resolution or he is simple destined to misguide and ill advise the PM?The second condition is that if the President Issues proclamation of emergency without such resolution then such proclamation must be produced before the both houses of the parliament within ten days of the proclamation of emergency.
What will happen on the 11th day by the way?
