The civil society has declared the Multi-Professional Cooperative Housing Society (MPCHS) case as a litmus test for institutions working to tackle corruption. The National Accountability Bureau (NAB) recently submitted before the Supreme Court of Pakistan (SC) a report on 150 mega corruption cases. The list presented by NAB in the Supreme Court has reignited the debate among public on the commitment of national institutions dealing with corruption scandals.
The issue of MPCHS has also stirred up once against.. The MPCHS-CDA scandal regarding the foul transaction of 54 acres of prime land worth 80 billion is of prime importance, the willingness of the prosecuting agencies to punish those involved in plundering national wealth and the willingness of CDA to settle the matter as per the directions of the SC will be judged by the outcome of this scandal. As per the Judgment by the SC vide its orders dated April 15, 2011 the court held and directed as under:
(a) Clause (iv) of regulation 4(1)A of the Regulation is declared to be inconsistent with sections 12 and 13 read with section 2(a) and (j) and consequently the JVA entered with MPCHS is rendered inoperative and ineffective qua CDA.
(b) The CDA Board is directed to takeover the project and complete the same in accordance with the provisions of the ordinance.
(c) The Chairman CDA shall ensure implementation of the above direction and submit compliance report within a period of one month from the date of this judgment.
(d) MPCHS will, however, be at the liberty to pursue the remedy for recovery of any amount spent on the project in accordance with the law.
Despite the clear direction by the Supreme Court, CDA has complete failed to implement the directions of the SC which points to the fact that CDA is not serious in ensuring transparency and that CDA is trying to protect those involved in this multi billion scam.
