India’s biased approach has not only been apparent in Kashmir dispute and Afghanistan policies but it has also put forward its partiality on the international treaties. It not only increased its occupation in Baluchistan but also accelerated its stubborn attitude against the ceasefire agreements on Indo-Pak border. India’s obstinacy was witnessed recently when it submitted its written pleadings to the International Court of Justice (ICJ) in the case of Indian spy Kulbhushan Jadhav who was arrested by Pakistan in 2016. He is accused of espionage and of mass killings in Pakistan. India has reminded Pakistan of the Vienna Convention in Jadhav’s case but has forgotten to mention the details regarding those who are involved in espionage charges. At the inception of it, no domestic law in both the countries allows Jadhav of consular access. But even if they talk about the international treaty, it won’t be a smooth road for India. Vienna Convention on Consular Relations, 1963 can’t be used to handcuff Pakistan by putting intense penalties on this Indian spy who himself confessed mass brutalities and lives of hundreds of innocents. This convention that both the countries have acceded to has strict rules in providing a consular access to the accused. It asks about the object, purpose and above all the national security of the state. It isn’t that Pakistan’s national security has some potential threats from this convict but the country already spotted the serious implications of his occupations. ICJ court has stayed the orders of Jadhav’s execution but then which court is going to provide justice to the hundreds of the people who lost their lives as the result of sectarian riots in Baluchistan and Sindh set up by the culprit. The list is a never ending one and includes not only SSP Chaudhry but number of others who got assassinated by his efforts. The ‘commissioned officer in the Indian Naval’ has been involved in the infiltration of about 40 RAW operatives along the Mekran Coast for Operations along with the Baloch insurgents. His sabotage activities in Pakistan would have brought more bloodshed to the country if it wouldn’t have been ceased with his March 03 arrest of last year. This case needs a more sensitive handling as is being done until now. It isn’t about espionage only but has been an issue of implicit terrorism which has cost Pakistan more than a world can imagine.
