ISLAMABAD: The Islamabad High Court on Wednesday ordered the release of Qazi Faiz Isa on bail, comparing the asset case against Bushra Bibi to the Tosha Khana case.
FIA Prosecutor Umeer Majeed appeared before Islamabad High Court Justice Mian Gul Hasan Aurangzeb in the bail application filed by PTI founder Imran Khan’s wife Bushra Bibi in the second case of Tosha Khana Tahaif.
The prosecutor argued that the gift received by the state must be submitted and declared. A gift is the property of the state unless it is legally purchased. The prosecutor said he could not be held in personal custody before buying an official gift.
Justice Aurangzeb inquired that if Bushra Bibi did not submit the gifts, why was Imran Khan, the founder of PTI, made an accused? Prosecutor Majeed replied that because her husband was a public office holder.
Justice Aurangzeb remarked that it was similar to the Justice Isa case. In this case too, the husband was held responsible for the actions of the wife.
Justice observed that even a British Prime Minister took gifts home. When asked, he replied that I had accepted the gift as per the rules.
Justice Aurangzeb asked the prosecutor that what will happen if Bushra Bibi returns the gift?
Prosecutor Majeed replied that there is scope for plea bargain in NAB law. But this facility was not there in the law of Tosha Khana.
The Justice asked him whether he had conducted any investigation after the transfer of the case. He replied in the negative.
Justice Aurangzeb granted Bushra Bibi’s bail and ordered her to be released on two sureties of Rs 10 lakh each.
